The Supreme Court of India recently ruled that an admiralty claim made against a Singapore-flag vessel almost six years ago must be heard in the Calcutta High Court although the relevant bills of lading contained an exclusive jurisdiction clause in favour of Singapore courts.

The Business Times, said the vessel owners could not simply rely on the fact that Singapore was named in the relevant documents as their principal place of business, but must prove that fact. They also had to show that Singapore courts were 'clearly or distinctly more appropriate', but had failed to do so.
