Position: Legal Advisor, Mining and Property
Location: Johannesburg, South Africa
Remuneration: R 850 000 - R 1 000 000 ctc excluding bonuses
Description:
The incumbent will be tasked with the following:
Keep abreast of changes to legislation affecting mining law and property and to ensure legal compliance, thereby preparing the company to meet increasing regulatory demands and public expectations. Secondly, the role is to represents business units at various levels to ensure stakeholder alignment with regards to property and property management which includes work related to Mining and Prospecting Rights. Additional work outcomes may be required to be performed by the incumbent. The Incumbent may be required to travel extensively.
Key Outputs:
§ Draft and Complete legal applications for mining and prospecting rights for the company:
o Conversions of mining rights and prospecting rights.
o Provision of legal advice on regulatory issues and applications for new mining rights and prospecting rights.
o Management of royalties' payable and periodical payments as well as management of prospecting fees payable
§ Assist with legal matters relating to new projects:
o Purchasing of land and relocation of communities and graves to enable execution of projects.
o Liaison with Land Affairs on Land Restitution claims and liaison with Public Affairs
oDrafting of leases, Purchase agreements, Servitudes, Letters to interested and affected parties.
· Custodians of legal administrative functions / duties
§ Establishment and Management of relationships with internal and external stakeholders:
o Transparent conversations and open engagement with stakeholders and liaison with the Deeds office and liaison with the Surveyor-General's Office
o Application and Registration of Servitudes
o Consultations with legal firms on litigation matters and representation of the organization at various forums
Requirements:
· Admitted Attorney
· 5 Years Post Qualification experience
· In depth knowledge of relevant legislation: Mineral and Petroleum Resource Development Act No 28 of 2002, Minerals Act No 5 of 1991, Mineral and Petroleum Royalty Bill, and Mine Health & Safety Act.
· Knowledge of the Broad Based Black Economic Empowerment Act, 2005, including the Code of Good Practice and BEE Scorecard.
