Social worker blamed for confession

Cynthia Buyiselwa, one of the co-accused in the murder of her boyfriend's son (3), claims a social worker brought her to 'a confessing state of mind' during an interview after she had reported the child missing, says a Cape Argus report.

Buyiselwa alleged in the Western Cape High Court that the social worker pushed her into a corner with his questions, which resulted in her making incriminating statements. The court will now hold a trial-within-a-trial to determine whether the information Buyiselwa gave the social worker can be admitted as evidence against her. Her lawyer objected to the fact that Buyiselwa was not informed of her right to have a legal representative present. In addition, he said, 'notions of fairness dictate' that the social worker had a duty to stop the questioning when the accused started making incriminating statements.
