Justice sector arrests 'an indictment' of law enforcement

Publish date: 02 November 2026
Issue Number: 1201
Diary: IBA Legalbrief Africa
Category: South Africa

In what is seen as a fatal indictment on the state of law enforcement in South Africa, the former head of the Investigating Directorate Against Corruption (Idac), Andrea Johnson, and former senior Crime Intelligence official Major-General Feroz Khan were in the Pretoria Magistrate’s Court on Friday to face charges related to defeating the ends of justice, assault GBH, and contraventions of the National Prosecuting Authority Act, notes Legalbrief Africa. Each was granted R10 000 bail, reports TimesLIVE. The case was postponed to 2 February 2027. Johnson has also been ordered to surrender her passport. According to IoL, their arrests on Friday morning follow allegations that Johnson shared confidential information from a criminal complaint against Khan, potentially compromising the investigation. This after Crime Intelligence officer Manana Phetlhe accused him of harassment and assault. It is alleged that Khan was allowed to review Phetlhe’s account before preparing his warning statement, potentially giving him an advantage in responding to the allegations. EWN reports that after the court proceedings, the National Prosecuting Authority's (NPA) Kaizer Kganyago explained why Johnson has been charged with contravening the NPA Act. ‘At the time when the alleged offence was done, Andrea Johnson wasn't the head of Idac. She was at the DPP office here in Pretoria, and it is alleged that she then gave information that she was not supposed to give to the accused person to allow them to prepare. Therefore, that is in contravention of the NPA Act.’

The controversy has also came under scrutiny at the Madlanga Commission, where former Hawks (special investigations unit) Colonel Kobus Roelofse raised serious concerns about the handling of the investigation. The commission is investigating claims that the justice system has been infiltrated by criminals. Roelofse, a former senior Hawks investigator, testified in Pretoria on 10 July that Johnson had allegedly interfered in a 2018 criminal complaint against Khan, notes IoL. He argued that her alleged involvement compromised the investigation and undermined the integrity of the criminal justice process. Khan’s arrest comes after his dismissal from the police service, following his failure to appear before the designated senior officer overseeing an expedited disciplinary process. Johnson resigned as Idac head in July after coming under intense scrutiny during the commission's proceedings. Her testimony followed allegations that Idac had operated outside its legal mandate and pursued a criminal case against Crime Intelligence head Dumisani Khumalo and other senior intelligence officials. The commission also heard allegations that Johnson and Khan maintained a close personal relationship that extended beyond theirprofessional association, placing their interactions under further scrutiny.
